The Royal Thai Government has recently announced that it will strictly enforce a re-entry ban for foreign visitors allegedly staying in Thailand beyond the authorised visa validity date.

Foreign visitors who violate the Immigration Act: B.E.2522 by overstaying more than 90 days in Thailand will be prohibited from re-entering the kingdom for a certain period of time as follows:

Overstaying more than 90 days to one year, the re-entry ban is one year.
Overstaying between 1 – 3 years, the re-entry ban is three years.
Overstaying between 3 – 5 years, the re-entry ban is five years.
Overstaying more than five years, the re-entry ban is ten years.


Foreign visitors found guilty who are apprehended by the Immigration officers will face the following penalties:

Overstaying less than one year, the re-entry ban is five years.
Overstaying more than one year, the re-entry ban is ten years.
The rules of overstay came into effect since 22 July, 2014.

Overstay blacklisting starts in March
Thailand's Immigration Bureau could start blacklisting foreigners who stay beyond their visa period with effect from March 2016.

The royal decree on the blacklisting is expected to be promulgated in late March, said bureau chief Pol Maj Gen Natthorn Prosunthorn.

He said that the foreigners would be divided into two groups: those on overstay who turn themselves to the authorities and those who are arrested for overstaying.
